Web Design Terms & Conditions
The following terms and conditions apply to all web design & development services offered by Richard Buddin t/a RichInternet Internet Services ("RichInternet"). By ordering web design & development services from RichInternet you are agreeing to the following terms and conditions.
Design:
The acceptance of a commission shall be deemed as a contractual agreement between the client and RichInternet. RichInternet cannot always guarantee to start work immediately on a commission but will arrange a date with the client as to when work can commence.
Sites designed by RichInternet are required to carry a linked logo (or an agreed alternative) on their contact page.
All material, both text and images supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws. The copyright for all material provided by RichInternet, such as HTML code, graphics, photographs and text, will remain the property of RichInternet until such time as payment has been made in full whereupon tRich may become the property of the client.
RichInternet makes every effort to design pages that display acceptably in the most popular current browsers, but cannot accept responsibility for pages that do not display acceptably in new versions of browsers released after pages have been designed.
RichInternet will initially place the client's web site on RichInternet's server during web site development process, in order that the client may view and comment upon the web site's progress. When both RichInternet and the client agree that the web site meets the criteria agreed during the commissioning process, RichInternet will invoice the client for the full amount due for the commission. On receipt of payment, RichInternet will publish the web site on the client's server, or provide the source code for the site via a download for the client to upload.
If, during the web site development process, the client does not supply the content required in order to complete the commission within a reasonable amount of time, RichInternet will consider that the client wishes to cancel the commission. Any work already undertaken in the development of the web site will be invoiced for and payment will be due within 30 days.
Maintenance:
RichInternet does not undertake to maintain or update a client's web site as part of the design commission. If a client wishes RichInternet to maintain or update a web site as a separate commission, we will negotiate with the client a maintenance contract appropriate to the amount of work required.
Payment:
RichInternet expects payment within 30 days of the date on the invoice.
RichInternet reserves the right to alter prices at any time without notice. If a client has commissioned any services from RichInternet prior to a change in prices that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.
Promotion:
RichInternet does not undertake to promote a client's web site as part of the design commission. If a client wishes RichInternet to promote a web site as a separate commission, RichInternet will make every reasonable effort to promote the web site effectively but cannot guarantee high positioning in search engine results.
Web Hosting Terms & Conditions
The following terms and conditions apply to all web hosting services offered by Richard Buddin t/a RichInternet Internet Services ("Rich Internet"). By ordering web hosting services from RichInternet you are agreeing to the following terms and conditions.
Location:
All accounts will be located on Windows 2000 shared servers unless otherwise specified. All prices quoted are for this option and are subject to change if site location is on Linux space or dedicated server space.
Webspace:
Hosting accounts are to be used by the primary owner only. Account holders are not permitted resell, store or give away web-hosting services of their web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
Site Content:
Space on RichInternet servers may not be used for the distribution of adult-oriented or racist material, pirate software, copyright material or for other illegal purposes. Contract (and service) may be suspended at any time if usage or site content is deemed inappropriate or offensive.
Under no circumstances, must any of the following materials appear on your web site. Pornographic/explicit or obscene material, in the form of graphics or text. Copyrighted music files (.wav, .mid, .mp3 etc.) or any form of sound used without the original owner's written consent. Copyright computer code / graphics without the original owner's written consent. Lists of software package serial numbers or links to cracks, patches, hacks or pirated software, pyramid advertising schemes and "spam" banners.
If any copyrighted material other than the holder of the account's own is to be stored on a RichInternet server, RichInternet must receive a signed photocopy or original letter giving explicit, specific permission from the copyright holder.
Errors & Omissions:
Although we always endeavour to keep your sites error-free and check them regularly for availability, you are advised that it is your responsibility to back up your files, check your web site for availability, correct content and operation. Errors and omissions should be reported via the contacts page as soon as possible for correction.
Passwords:
You are responsible for keeping records of your FTP, mail and access passwords and keeping these secure at all times. Failure to do so, where a breach of security occurs, may result in termination of your account, as will attempted access to accounts you do not own.
Mail Usage:
Your e-mail accounts may not be resold or used to send unsolicited e-mail (spamming). Clients who send, or allow the sending of such mail (even using external mail facilities) will have their service terminated immediately and will be liable for any costs incurred by the result of their actions. Outgoing (SMTP) mail facilities are not provided as standard (you can usually use your ISP's outgoing mailserver) but special arrangements can be made on request.
High Resource Use:
Resources are defined as bandwidth and/or processor utilization. RichInternet may implement the following policy to its sole discretion:
In order to maintain quality of service to all our clients, we reserve the right to suspend or terminate an account where it is found to be manipulating or monopolizing server resources to the detriment of other users, whether via scripts, programs, volume of mail, excess bandwidth or otherwise. It is strongly suggested that any script development is carried out on your local PC before uploading to the server, as incorrectly configured scripts may seriously affect server performance.
The hosting packages available on this web site are not intended to be used as file respositories nor as code development test-beds. RichInternet reserves the right to remove any sites which it believes are being used for such purposes.
Loss of Service:
RichInternet web space, domain registration and e-mail services are derived in some part via partnerships with third-party companies. No responsibility will be accepted for loss of service or consequences of such caused by server failure or actions of any of our partners, service providers, or their subcontractors, representatives or employees. This includes loss of data resulting from failures, delays, nondeliveries, wrong delivery, and any and all service interruptions. No SLA or uptime guarantees are given, although every effort will be made to maintain service. No warranties or claims of merchantability or fitness for a particular purpose are made - either expressed or implied for services provided.
Bandwidth (data transfer) limits:
Our basic webspace accounts have pre-set strict bandwidth limits - keeping hosting fees at very competitive levels for low-traffic sites. If an account's limit is reached, you may be asked to pay bandwidth fees on a monthly basis or upgrade to an account with higher bandwidth limits We'll be pleased to discuss this with you before you place your order or when designing your site.
Payment:
All accounts are set up on a prepay basis. Although RichInternet reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be invoiced again at the end of their prepay period unless a cancellation notification has already been received. No refund will be given for annual hosting fees if you choose to relocate your domain, although prompt transfer to a new host will be arranged free of charge.
In the event of late payment, your service may be discontinued or suspended until full payment is made. No responsibility will be accepted for loss of service or consequences of such action. Services ordered are accepted on a "firm order" basis and fees, when requested via invoice, are payable strictly within 7 days from invoice date.
Cancellations & Refunds:
We require 30 days cancellation notice in writing. When you cancel your account, all your files and access passwords will be deleted. RichInternet reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon their remaining period of membership. If a customer contravenes RichInternet's terms of service and incurs cancellation, a refund will not be issued.
With the exception of domain names, a seven day cooling-off period applies to our products and services. In these seven days customers are entitled to cancel the contract and obtain a refund for their purchase.
Domain Names Terms & Conditions
The following terms and conditions apply to domain registration services offered by Richard Buddin t/a RichInternet Internet Services ("RichInternet"). By ordering domain registration services from RichInternet you are agreeing to the following terms and conditions. Please note that when registering second level .uk domains with ourselves that you are also bound by Nominets UKs' Terms and Conditions as well as our own. We will not be able to confirm that we are able to register your chosen domain name for you until we have received notification from the appropriate domain registry that the application was successful. All domain names will remain the property of RichInternet until full payment for that domain name has been received.
We will not accept responsibility for errors made by Registration Authorities, registrars or their agents when submitting domains for registration. Claims against RichInternet for incorrect registration on our part will be limited to replacement domains to the same retail value, at our discretion. No claims for compensation will be accepted for loss of use due to late payment.
You will be responsible for picking a domain name that does not infringe any copyrights or trademarks. If you do infringe trademark or copyright, you risk having legal action taken against you and losing the domain name to the owner. Your registration fees and RichInternet hosting charge will not be returnable in this case. If you choose a .ltd.uk or .plc.uk name, it is required to be the same as your registered company name (with spaces removed or replaced with hyphens as appropriate) and you must provide your Company Registration Number with your application. Please be aware that recent domain extensions may have their own rules on acceptability, eligibility, trademark infringement and "passing off".
Late Payment:
We reserve the right not to release domain names whose owners' account fees remain unpaid until all invoices are settled in full. Domains remaining unpaid for may become lapsed or detagged.
General Terms & Conditions
Indemnification
Customer agrees to defend, indemnify, save and hold RichInternet harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against RichInternet, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless RichInternet against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with RichInternet's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to the Customer from a RichInternet server.
Disclaimer
RichInternet will not be responsible for any damages a Customer’s business may suffer. RichInternet makes no warranties of any kind, expressed or implied for services provided. RichInternet disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by RichInternet and its employees. RichInternet reserves the right to revise its policies at any time.

Privacy Policy
Data Collection
During your visit to a site on the RichInterne! network we may gather information relating to your geographic location, operating system, browser and referring information. This data is collected in bulk and can not be tracked down to an individual session.
Use of Cookies
Our support web site and clients area uses cookies to remember your login and track usage. These are deleted once the browser is closed or you click 'log out'. Our web hosting control panel also uses cookies in a similar way.
Personal Information
When you sign-up for a service with RichInternet we require information such as name, address and other contact details. This information is held by us - we do not pass on or sell this information to any third party. The only exception to this is when we register domain names on your behalf. We must then provide your details to the registrar to allow the domain to be registered in your name. Information is only released if required by law.
External Sites
We may provide links to external sites and partner sites. We have no influence over and cannot be held responsible for the sites content or Privacy Policy.
